Burkhart Cemetery, Inc. is a Missouri nonprofit mutual benefit corporation organized under Chapter 355 of the Revised Statutes of Missouri and recognized by the Internal Revenue Service as a tax‑exempt cemetery corporation under Section 501(c)(13) of the Internal Revenue Code.

In accordance with state and federal requirements, the following documents are available for public inspection:

Articles of Incorporation – Filed June 15, 2017 with the Missouri Secretary of State

Establishes Burkhart Cemetery, Inc. as a Missouri nonprofit corporation.

Bylaws – Governing the operation and management of the cemetery

Defines how the cemetery is governed, including board structure and responsibilities.

IRS Determination Letter – Confirming federal tax‑exempt status

Confirms our federal 501(c)(13) tax‑exempt status.

Form 1023- Application for Recognition of Exemption

The original application submitted to the IRS requesting tax‑exempt recognition.

Annual Form 990‑N filings

Annual IRS filings required for small tax‑exempt organizations.

Burkhart Cemetery, Inc. was recognized by the IRS as a 501(c)(13) tax‑exempt cemetery corporation in 2026. Our first required annual return was the Form 990‑N for the 2025 tax year, which was filed after receiving federal approval.

IRS Public Inspection Requirement: Tax‑exempt organizations must make their three most recent annual returns (Form 990‑N, 990‑EZ, or 990) available for public inspection. Newly exempt organizations only need to provide the returns they have actually filed. As each new year is filed, the oldest year drops off.
